  • You will not engage in any activity that disrupts or interferes with the website’s functionality.

We reserve the right to refuse service or terminate access at our discretion.

3. Product Availability & Seasonal Nature

All products are offered subject to availability. Agricultural products are inherently seasonal and may be affected by weather, pests, and other growing conditions beyond our control.

We reserve the right to limit quantities, discontinue products, or cancel orders at any time. If an order cannot be fulfilled, customers will be notified and issued a refund or replacement when appropriate.

4. Orders & Payment

  • Payment is due at the time of purchase unless otherwise agreed to in writing.

  • Certain orders, including custom, bulk, wholesale, or landscape orders, may require a non-refundable deposit (typically 50%).

  • We reserve the right to cancel orders for non-payment or suspected fraud.

5. Pricing

All prices are listed in U.S. Dollars and are subject to change without notice. Prices do not include shipping, delivery, taxes, or applicable fees unless explicitly stated.

6. Shipping & Delivery

Shipping and delivery dates are estimates only and are not guaranteed.

Once an order is transferred to a shipping carrier, Taza Creek Orchard is not responsible for delays, damage, or loss caused by the carrier, weather events, or circumstances beyond our control.

Live plants and perishable goods carry inherent shipping risks, which the customer acknowledges upon purchase.

7. Local Delivery & Pickup

Local delivery and pickup options may be available by prior arrangement. Customers are responsible for providing accurate delivery information. Missed deliveries may result in additional fees.

8. Returns, Refunds & Exchanges

Due to the nature of live and perishable agricultural products:

  • All sales of live plants, fresh produce, and perishable goods are final.

  • Refunds or replacements may be considered at our discretion if:

    • The incorrect item was sent, or

    • Items arrived severely damaged, and photographic documentation is provided within 24 hours of delivery.

  • We are not responsible for plant stress, transplant shock, or damage occurring after delivery.

9. Plant Care & Performance Disclaimer

We do not guarantee plant growth, survival, yield, or performance. Plant success depends on many factors including climate, soil conditions, planting practices, and ongoing care, all of which are beyond our control.

10. Organic & Growing Practices Disclosure

We may describe certain products as grown using organic or sustainable practices. Unless explicitly stated, this does not imply certified organic status. Growing practices may include natural inputs, integrated pest management, and environmentally responsible methods.

11. Limitation of Liability

To the fullest extent permitted by law, Taza Creek Orchard shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website or products.

Our total liability shall not exceed the amount paid for the product giving rise to the claim.
